Respecting the right to privacy of individuals who visit our website, we hereby declare that any data obtained in this manner is processed in accordance with national and European Union law and under conditions ensuring its security, i.e. confidentiality, availability, integrity, and accountability of the operations performed. In order to ensure transparency of our data processing activities, we present the personal data protection principles applicable within the Eternis Group, established on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter “GDPR”).

By accepting this Privacy Policy, you consent to the Controller of personal data and entities within the Eternis Group processing your data provided in contact forms and collected via cookies, in accordance with applicable law and the consents you have granted.

I. Who is the Controller of your personal data?

The controller of your personal data is the operator of the website www.eternis.pl, i.e. Eter Connect sp. z o.o., with its registered office in Warsaw, Aleja Niepodległości 18, 02-653 Warsaw, entered into the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000858523, NIP: 5223189244 (the “Company”), or one of the companies within the Eternis Group with which you establish contact via forms available on the website (each of which acts as a separate controller of your personal data).

II. What personal data do we process?

In connection with your use of our website, we process the following personal data obtained via:

contact forms on the website: your first and last name, and contact details (email address and phone number);

the chatbot available on the website: the content of the conversation, your first and last name, contact details, IP address;

cookies: your IP address, information on how you use our website, browsing time, user location, type of operating system, and language version used on your device. In addition, the above information may be combined with other personal data you have provided to the Company, in particular via contact forms made available to you.

III. Purpose and legal basis for processing your personal data

The Company and entities within the Eternis Group process your personal data for the following purposes:

a) to enable you to use our website for informational purposes (legal basis: the Company’s legitimate interest in providing access to its website, ensuring its functionality and optimisation, and maintaining IT system security – Article 6(1)(f) GDPR);

b) to establish contact following submission of contact forms such as “Start working”, “Rent a vehicle”, “Start driving with…”, “Start delivering with…”, aimed at initiating cooperation with one of the companies within the Eternis Group (legal basis: steps taken prior to entering into a contract – Article 6(1)(b) GDPR);

c) to establish contact via the chatbot available on our website or to process data submitted through it for the purpose of initiating cooperation with one of the companies within the Eternis Group (legal basis: the Controller’s legitimate interest in responding to inquiries, which constitutes a legitimate interest of the Eternis Group companies – Article 6(1)(f) GDPR, or steps taken prior to entering into a contract with one of the Eternis Group companies – Article 6(1)(b) GDPR);

d) to establish contact via messaging applications such as WhatsApp and Telegram, which constitutes the Controller’s legitimate interest in responding to inquiries (Article 6(1)(f) GDPR);

e) to send commercial information for marketing purposes, including information about products or services of Eternis Group companies (legal basis: the legitimate interest of the Eternis Group companies – Article 6(1)(f) GDPR, subject to your separate consent for selecting a specific communication channel by ticking the appropriate checkbox, in accordance with separate regulations);

f) to assert or defend against legal claims related to the functioning of the website, as well as to prevent crimes and conduct related investigations (legal basis: the Company’s legitimate interest – Article 6(1)(f) GDPR);

g) to comply with obligations imposed on the Company or entities within the Eternis Group under generally applicable law, in particular tax and accounting regulations (legal basis: Article 6(1)(c) GDPR).

IV. Social Media and Messaging Platform Plug-ins

Our website also includes social media and messaging platform plug-ins, implemented as dedicated buttons that enable you to establish a direct connection with the servers of the relevant social media platform or messaging service. The website eternis.pl uses the following plug-ins and widgets:

• TikTok

TikTok features have been integrated into our website. When you use TikTok, the websites you visit may be linked to your TikTok account and shared with other users. If you are not logged into your TikTok account, clicking the TikTok icon will redirect you to the TikTok login page, where you may enter your login credentials. In this case, your data will also be transmitted to TikTok.

V. To whom may we disclose your personal data?

Your personal data may be disclosed to authorised public authorities, companies within the Eternis Group (to the extent that such companies provide services to one another or to the extent that they relate to activities undertaken by you with one of the companies within the Eternis Group), as well as entities providing services to the Controller on the basis of concluded agreements and in accordance with the Controller’s instructions, including in particular IT service providers acting on behalf of the Controller.

In addition, when using the “Start driving with …” section or the chatbot on our website, by selecting a service provider for whom you wish to perform services, your personal data provided in the form—i.e. first name, last name, telephone number, and email address—will be shared with the selected provider (i.e. Uber, Bolt, Wolt, FreeNow, etc.).

The disclosure of your personal data to the provider constitutes our legitimate interest (Article 6(1)(f) GDPR), consisting in enabling the provider to create an account for you, which is necessary to establish cooperation with one of the companies within the Group and to settle payments arising therefrom. Once an account has been created for you by the provider, the provider becomes the controller of your personal data in this respect.

VI. For how long will we process your personal data?

Your personal data will be processed until the legal basis for processing ceases to exist, or until the purpose of processing has been achieved, or ceases for another reason.

In particular, where:

a) the basis for processing is the legitimate interest of the Company or one of the companies within the Eternis Group, personal data will be stored until the legitimate interest is fulfilled or until you object to the processing of your personal data. In the case of personal data provided via the chatbot or contact forms, if no agreement is concluded with you, such data will be deleted no later than within 30 days;

b) data is processed on the basis of a contract, personal data will be processed for the duration of the contract binding you with the Company, and thereafter for the period required by law (tax and accounting regulations)—generally 5 tax years;

c) data is processed on the basis of your consent, it will be processed until the consent is withdrawn, which does not affect the lawfulness of processing carried out prior to its withdrawal by the Company or one of the companies within the Eternis Group.

The above retention periods may be extended where processing is necessary for the establishment, assertion, or defence of legal claims, and thereafter only where and to the extent required by applicable law.

VII. Do we make automated decisions regarding your data?

No automated decision-making (i.e. decisions made without human involvement) will be carried out in relation to your personal data. Your data will not be subject to automated profiling.

VIII. Cookies

We may collect your data through technologies such as cookies, which enable the identification of a browser or device.

Cookies are IT data, in particular text files, which are stored on the end-user’s device (e.g. computer, tablet, etc.) and are intended for use with the website. Cookies typically contain the name of the website from which they originate, the duration of their storage on the end device, and a unique identifier. Cookies identify the computer and browser used to browse websites—for example, they allow us to determine whether a given device has previously visited the website.

Data obtained from cookies is not, in any way, combined with users’ personal data, i.e. it does not affect the functioning of end devices and does not cause any configuration changes in the software installed on those devices.
